The citizen of the U.S. petitions to the USCIS Service Center for
a K1 fiancee visa
approval, the approval is forwarded to the foreign U.S. consulate
where the foreign fiancee lives. K1

The foreign fiancee gathers the paperwork, attends an interview,
and gets the K1 fiancee visa, travels to the U.S., marries in the
U.S. and applies for adjustment of status during the first 90 days.
Total time estimated: 6-9 months. This is usually the best method
IF the foreign fiancee does not have a tourist visa (or visa waiver).
K1 Fiance Visa/ K3 Spousal Visa Preparation
If your fiance/ fiancee is not a citizen of the USA
and you plan to get married in the United States, then you must
file a petition with USCIS on behalf of your fiance/ fiancee .
After the petition is approved, your fiance/ fiancee must obtain
a visa issued at a U.S. Embassy or consulate abroad. The marriage
must take place within 90 days of your fiance/ fiancee entering
the United States. If the marriage does not take place within 90
days or your fiance/ fiancee marries someone other than you (the
U.S. citizen filing USCIS Form I-129F - Petition for Alien Fiance/
Fiancee), your fiance/ fiancee will be required to leave the United
States. Until the marriage takes place, your fiance/ fiancee is
considered a nonimmigrant.
A nonimmigrant is a foreign national
seeking to temporarily enter the United States for a specific purpose.
A fiance/ fiancee may not obtain an extension of the 90-day original

Work Permit
Work Permit Applicants for adjustment to permanent resident status are eligible
to apply for a work permit while their immigation cases are pending.
You should use USCIS Form
I-765 to apply for a work permit. You do not need to apply
for a work permit once you adjust to permanent resident status.
As a lawful permanent resident, you should receive a permanent
resident card that will prove that you have a right to live and
work in the USA permanently. Please see How

Permanent Resident Status
If you are applying for adjustment to permanent resident status,
you must receive advance permission to return to the United States
if you are traveling outside the USA. This advance permission is

Permanent Residency
The only applications for permanent residency (Form
I-485) which can be appealed to USCIS are those based on a marriage
which took place while the alien's application was in process or
those based on Section 586 of Public Law 106-429, adjustment of
status for certain nationals of Vietnam, Cambodia and Laos. These
appeals must be made to the Administrative Appeals Unit (AAU).
